WAIVER AND RELEASE OF LIABILITY

In consideration of being allowed to participate in any way in programs, events, and activities organized by 2020 Racing Inc. doing business as Team Cobras, a Colorado nonprofit corporation ("Team Cobras") (collectively, the "Team Cobras Programs"), I agree as follows:

Acknowledgement of Risk
I understand that participating in the Team Cobras Programs involves significant risks, including serious injury, permanent disability, and death. While certain skills, equipment, and personal precautions can reduce these risks, they cannot eliminate them.
Assumption of Risk
I knowingly and voluntarily assume all risks associated with my participation in the Team Cobras Programs, whether those risks are known or unknown and whether they arise from the actions, omissions, or negligence of the Releasees or others.
Compliance and Duty to Report Hazards
I agree to follow all rules and customary terms for participation. If I observe any unsafe condition or hazard while present at or participating in any Team Cobras Program, I will remove myself from participation and notify a Team Cobras representative immediately.
Release, Indemnification, and Hold Harmless
On behalf of myself, my heirs, assigns, personal representatives, and next of kin, I RELEASE, DISCHARGE, INDEMNIFY, AND HOLD HARMLESS Team Cobras and USA Cycling, Inc., and their officers, directors, officials, agents, employees, representatives, members, other participants, sponsors, advertisers, and owners or lessors of premises used for the Team Cobras Programs (collectively, the "Releasees"), FROM ANY AND ALL LIABILITY for injury, disability, death, or damage to person or property arising from my participation or presence in the Team Cobras Programs, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, TO THE FULLEST EXTENT PERMITTED BY LAW.
Media Release
I grant Team Cobras and its successors and assigns the unrestricted, royalty-free, perpetual right to use, reproduce, publish, and republish photographic, digital, or other images of me related to Team Cobras for any purpose, including promotional or advertising uses. Team Cobras may assign this right to sponsors or others.
Age and Understanding
I REPRESENT THAT I AM AT LEAST 18 YEARS OF AGE. I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, I FULLY UNDERSTAND ITS TERMS, AND I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. I UNDERSTAND THAT BY SIGNING I GIVE UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE THE RELEASEES.

I HAVE CAREFULLY READ THE PRECEDING AND UNDERSTAND ITS TERMS. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING MY RIGHT TO SUE RELEASEES AS SET FORTH ABOVE. I ACKNOWLEDGE THAT I AM SIGNING THIS AGREEMENT FREELY AND VOLUNTARILY. I INTEND MY ELECTRONIC OR HANDWRITTEN SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT PERMITTED BY LAW.
